Article 1 (Application)

  1. These Terms apply to all relationships between the User and the Company concerning the use of the Service.
  2. In connection with the Service, we may, in addition to these Terms, establish various rules and other provisions (hereinafter referred to as "Individual Provisions"). These Individual Provisions shall form part of these Terms regardless of their title.
  3. If any provision of these Terms conflicts with the provisions of the individual provisions set forth in the preceding paragraph, the provisions of those individual provisions shall prevail, unless otherwise provided in those individual provisions.

Article 2 (User Registration)

  1. For this Service, a prospective registrant shall apply for user registration in the manner specified by the Company after agreeing to these Terms, and the user registration will be completed when the Company notifies the prospective registrant of its approval.
  2. We may refuse to approve an applicant's registration if we determine that any of the following apply, and we shall have no obligation to disclose the reasons for such refusal.
    1. If false information is submitted when applying for user registration
    2. If the application is from someone who has previously violated these Terms
    3. Otherwise, if the Company determines that the user registration is inappropriate

Article 3 (Management of User IDs and Passwords)

  1. Users are responsible for managing their user ID and password for this service.
  2. Users must not, under any circumstances, transfer or lend their user ID or password to any third party, or share them with any third party. If a login is made with a user ID and password combination that matches the registered information, we will consider that use to be by the user who registered that user ID.
  3. The Company shall not be liable for any damages resulting from the use of a user's ID or password by a third party, except in cases where the Company is at fault due to willful misconduct or gross negligence.

Article 4 (Sales Contract)

  1. Under this service, a sales contract shall be concluded when a user submits a purchase application to the Company and the Company notifies the user that it has accepted that application. Ownership of the product shall transfer to the user when the Company hands the product over to the carrier.
  2. We may, without prior notice to the user, terminate the sales contract referred to in the preceding paragraph if the user falls under any of the following circumstances.
    1. If the user violates these Terms
    2. If product delivery cannot be completed due to an unknown delivery address or prolonged absence
    3. Any other cases in which the Company determines that the relationship of trust with the user has been compromised.
  3. Payment methods, shipping methods, procedures for canceling purchase requests, and return procedures related to this service shall be as separately specified by the Company.

Article 5 (Intellectual Property Rights)

The copyrights and other intellectual property rights in product photographs and other content provided through this Service (hereinafter referred to as "Content") belong to the Company and the legitimate rights holders such as content providers, and users may not reproduce, republish, modify, or otherwise reuse them without permission.

Article 6 (Prohibited Conduct)

Users must not engage in any of the following activities when using the Service.

  1. Acts that violate laws or public order and morals
  2. Activities related to criminal activity
  3. Acts that infringe copyrights, trademark rights, or other intellectual property rights included in this service.
  4. Acts that destroy or interfere with the operation of our servers or networks
  5. Using information obtained through this service for commercial purposes.
  6. Any act that may interfere with the operation of our services
  7. Acts of unauthorized access or attempts to do so.
  8. Collecting or storing other users' personal information or similar data
  9. Impersonating other users
  10. Providing benefits, directly or indirectly, to antisocial forces in connection with our services
  11. Other conduct that we deem inappropriate

Article 7 (Suspension or Interruption of the Service)

  1. We may suspend or interrupt all or part of the Service without prior notice to users if we determine that any of the following circumstances apply.
    1. When performing maintenance, inspections, or updates on the computer systems related to this service
    2. If providing this service becomes difficult due to force majeure such as earthquakes, lightning strikes, fires, power outages, or other natural disasters
    3. If computers, communication lines, etc. are interrupted due to an accident
    4. Other cases where the Company determines that it is difficult to provide the Service.
  2. We shall not be liable for any disadvantage or damage suffered by users or third parties resulting from suspension or interruption of the Service, regardless of the cause.

Article 8 (Restrictions on Use and Cancellation of Registration)

  1. If any of the following applies, the Company may, without prior notice, restrict a user's use of all or part of the Service or delete the user's registration.
    1. In the event of a breach of any provision of these Terms
    2. If it is discovered that any registration information is false
    3. If the credit card the user registered as a payment method is suspended
    4. If there is a default in payment obligations such as fees
    5. If there is no response to communications from our company within a certain period
    6. Regarding this service, if there has been no use for a certain period since the last use
    7. Other cases where the Company determines that use of this Service is inappropriate
  2. The Company shall not be liable for any damages suffered by users arising from actions taken by the Company pursuant to this Article.

Article 9 (Membership Cancellation)

Users may withdraw from the Service by following the designated withdrawal procedure.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

  1. We do not guarantee that the Service is free from any factual or legal defects (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, or infringement of rights).
  2. We shall not be liable for any damages incurred by users arising from the Service. However, if the contract between us and a user concerning the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act, this disclaimer shall not apply; even in that case, we shall not be liable for any special damages suffered by the user among the damages caused by our breach of contract or tort due to our negligence (excluding gross negligence), including damages that we or the user foresaw or could have foreseen.
  3. The Company shall not be liable for any transactions, communications, or disputes that arise between a user and other users or third parties in connection with the Service.

Article 11 (Changes to the Service, etc.)

We may, without notifying users, change the content of the Service or suspend its provision, and we shall not be liable for any damages suffered by users as a result.

Article 12 (Changes to the Terms of Use)

The Company may, when it deems necessary, change these Terms at any time without notifying users. If a user begins using the Service after the Terms have been changed, that user shall be deemed to have agreed to the revised Terms.

Article 13 (Handling of Personal Information)

We will appropriately handle any personal information obtained through the use of this service in accordance with our "Privacy Policy".

Article 14 (Notices or Communications)

Notifications or communications between the user and the Company shall be made by the method specified by the Company. Unless the user submits a change notification in accordance with the procedure separately prescribed by the Company, the Company will regard the currently registered contact information as valid and send notifications or communications to that contact information, and such communications shall be deemed to have reached the user at the time of transmission.

Article 15(Prohibition on Assignment of Rights and Obligations)

Users may not, without the Company's prior written consent, assign to any third party or pledge as collateral their position under the Service Agreement or any rights or obligations under these Terms.

Article 16 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
  2. If a dispute arises regarding this Service, the court with jurisdiction over the location of our head office shall have exclusive jurisdiction.
